Terms and Condtions

TERM AND CONDITIONS

For the purposes of these Terms & Conditions, Cairns Boat Charters, including the vessel of Allure, will be referred to as “CBC”. CBC is owned and operated by Passions of Paradise Pty Ltd.

BOOKINGS

Bookings are not confirmed until the deposit or full payment is received by CBC.

Upon receiving confirmation of the booking, you should check all booking details carefully and immediately notify us of any discrepancies. The customer/agent is responsible for any details that are incorrect; this includes but not exclusive to names, dietary restrictions, dates, and itinerary requests.

All passengers are required to re-confirm their booking 48 hours prior to departure.

PAYMENTS

All payments are to be paid in accordance with the partnership agreement.

Unless stated otherwise, all prices are charged in AUD and are inclusive of GST and levies

CUSTOMER CANCELLATIONS

Customer cancellations are any cancellations initiated by the customer or their authorised representative, including a travel agent, regardless of the reason for the cancellation.

  • Cancellations made 7 days or less prior to the departure date will incur a 100% cancellation fee (no refund).
  • Cancellations made between 8 and 28 days prior to the departure date will incur a 50% cancellation fee (50% refund).
  • Cancellations made 29 days or more prior to the departure date will incur no cancellation fee (full refund).

OPERATOR CANCELLATIONS

In the event of adverse weather, we reserve the right to cancel the charter at any time before or during the experience.

All cancellations initiated by CBC prior to departure will be refunded in full, and any cancellations made during the experience will be assessed in accordance with circumstances and experience.

ITINERARY

CBC operates private charter experiences without a fixed or guaranteed itinerary. All itineraries are subject to change and will be determined by weather conditions, sea conditions, safety considerations, the duration of the charter, and the overall guest experience, at the sole discretion of the Master and/or CBC.

OPERATING AREA

CBC operates private charter experiences within the Great Barrier Reef Marine Park. Charter destinations may include, but are not limited to, outer reef sites, island reef sites, fringing reefs, coral cays, sand cays, and other suitable locations within the operating area.

WEATHER CONDITIONS

Rain and wind are not, by themselves, considered adverse weather conditions. Due to the tropical climate in which CBC operates, rainfall, changing wind conditions, and variable weather are common and should be expected.

SCUBA DIVING

Scuba diving in Queensland has strict medical requirements. Certain medical conditions (including but not limited to asthma, heart conditions, diabetes, or the use of prescription medication) may prevent participation in diving activities.

Some passengers may be required to obtain medical clearance from a doctor prior to diving. Please note that medical clearance must meet recognised diving medical standards and may be declined if it is deemed insufficient or not appropriate for scuba diving.

Participation in diving activities is subject to approval by our qualified dive instructors, and final decisions are made with safety as the highest priority.

Liability and Travel Insurance

By confirming a booking with CBC, guests acknowledge and agree that, where CBC cancels or changes a booking for any reason, CBC’s liability is limited to a refund of the amount paid for the affected charter or the unused portion of the charter, where applicable. To the maximum extent permitted by law, CBC is not liable for any consequential or incidental losses, including but not limited to travel costs, accommodation, meals, loss of income, alternative transport, or any other expenses incurred as a result of the cancellation or change.

CBC strongly recommends that all guests obtain comprehensive travel insurance at the time of booking. Travel insurance should provide cover for, including but not limited to:

  • Charter cancellation or interruption.
  • Personal injury and medical expenses.
  • Loss, theft or damage to personal belongings.
  • Travel delays and additional accommodation or transport costs.
  • Any other unforeseen circumstances that may affect your travel plans.
  • Guests are responsible for ensuring their insurance policy provides appropriate coverage for their individual circumstances.

CBC reserves the right to alter Terms, Conditions and Pricing without notice.
